Terms of Service

These terms govern your use of Welles — the macOS app, the marketing site, the CLI, and the hosted services that power AI features and shared recordings. By signing in, you agree to them. If you don't, don't.

1. The service

Welles is a macOS screen recorder with an AI-assisted editor. We provide the local app, the hosted API that backs AI features and sharing, and the CLI that drives both. Some features run entirely on your Mac; others require connecting to our backend and may be metered.

2. Your account

• You need an account to use hosted features. You must provide accurate information and keep your sign-in credentials secure.
• You are responsible for activity under your account. Notify us at hello@lonelyheartsclub.xyz if you suspect unauthorized use.
• We may suspend or terminate accounts that violate these terms or that put the service at risk.

3. Free trial and paid plans

• New accounts get one trial recording with AI features included. After that, AI features and recording new videos require an active paid plan.
• Paid plans are billed in advance through Stripe at the prices and intervals shown in-app at signup. Prices may change with 30 days' notice.
• Subscriptions auto-renew until cancelled. Cancel from Settings → Billing → Portal at any time; access continues until the end of the paid period.
• Lifetime plans grant access to the version family at purchase plus the future updates we explicitly include — major rebrands or platform shifts may be separate.
• Refunds: full refund within 14 days of first paid invoice if the product doesn't fit. After that, refunds are handled case-by-case.

4. Your content

You retain ownership of recordings, scripts, and any other content you create with Welles. By using hosted features (uploading, sharing, invoking AI), you grant Lonely Hearts Club a non-exclusive, worldwide licence to host, transmit, transform, and serve your content for the purpose of providing the service to you and the audiences you choose to share with. We do not use your content to train models.

5. Acceptable use

• Don't use Welles to record or share content you don't have the right to capture (private conversations, copyrighted streams, etc).
• Don't generate content that targets a specific individual with harassment, defamation, or sexual material without consent.
• Don't probe, scrape, or attempt to bypass our quotas, paywalls, or authentication.
• Don't resell access to the hosted backend without a written agreement with us.

6. AI features

Generative outputs — scripts, voiceovers, music — are produced by third-party models we invoke on your behalf (currently OpenAI, Anthropic, ElevenLabs). The outputs are not fact-checked or human reviewed; you're responsible for what you ship. Models can produce inaccurate, biased, or unexpected output; treat them as drafts, not final copy.

7. Service availability

We aim for high availability but make no uptime guarantee outside an explicit enterprise agreement. We may take the hosted backend down for maintenance with prior notice when feasible. Local recording continues to work even when our servers don't.

8. Disclaimers and liability

The service is provided "as is" and "as available". To the fullest extent allowed by law, Lonely Hearts Club disclaims all implied warranties (merchantability, fitness, non-infringement). Our aggregate liability for any claim is limited to the greater of $50 or the amount you paid us in the 12 months before the claim. Some jurisdictions don't allow these limits; in those, our liability is limited to the maximum permitted.

9. Termination

You can stop using Welles or delete your account anytime. We may suspend access for breach of these terms; we'll give you a chance to cure when feasible. On termination, your hosted shares and uploaded files are deleted within 30 days; locally stored recordings stay on your Mac.

10. Changes to these terms

We may update these terms; if a change is material we'll email you at the address on file at least 30 days before it takes effect. Continued use after the effective date counts as acceptance.

11. Governing law

These terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws rules. Disputes go to the state and federal courts located in New York County, NY.
